CERN can accept that a contractor seeks injunctive relief from the competent arbitration tribunal mentioned in the licence agreement’s dispute resolution clause. However, CERN cannot accept that the contractor be allowed to seek injunctive relief from a court, as this is not compatible with CERN’s immunity from court jurisdiction.
