The Procurement Officer shall consult the Technical Officer to determine who the end users of the software are and what their status is at CERN. It is important to note that the term ‘employee’ does not include CERN’s associated members of personnel (such as ‘users’). Therefore, in many cases it is necessary to negotiate a change in the licence agreement terms so that CERN’s ‘members of personnel’ (not just CERN’s ‘employees’) are allowed to use the software.
