A disclaimer might be implemented within the contractor’s terms to restrict Services’ use and/or availability.

While this is standard practice for the contractor to limit the warranty to substantial conformity and to set up a Service Level Agreement, it is instrumental to ensure some minimum level of warranty. Waiver such as "the services do not promise or guarantee compliance with any law or regulation" allows the contractor to provide services that CERN may not be allowed to use or that are simply unavailable for us at CERN.

The Procurement Officer should make sure:

• the definition of the Services is clear and fair;
• to compile all limitations of warranty within the corresponding clause.
